By accessing the Website, submitting any form, booking a service, purchasing a product, or enrolling in any program, you agree to be bound by these Terms. If you do not agree, do not use our Website or services.
1. About Alma Art House LLC
All programs are for educational purposes. Individual results will vary based on personal understanding, personal effort, experience, and implementation. No income, financial or performance results are promised or guaranteed in any way. Any testimonials, results, or examples shared represent that of the individual who is sharing their experiences and are not guarantees. Due to the digital nature of this and all programs, all sales are final and no refunds are offered for any reason.
Alma Art House LLC operates four distinct service lines under one entity:
- Alma Restorative — paramedical and medical tattooing (areola/nipple restoration, scar camouflage, navel restoration, scalp micropigmentation)
- Alma Ceremony — ceremonial tattoo sessions including abstract freehand tattooing with immersive sound bath experiences
- Alma Fine Art — original fine art paintings available for purchase, shipping, pickup, and delivery
- Alma Fine Art Tattoo Edu — tattoo education courses, workshops, intensives, and apprenticeship programs
All four service lines are operated by Alma Art House LLC. References to any service line in these Terms are references to Alma Art House LLC.
2. Eligibility
You must be at least 18 years of age to use this Website, book services, purchase products, or enroll in any program. By agreeing to these Terms, you represent that you are at least 18 years old and legally capable of entering into a binding contract. We reserve the right to refuse service to anyone at our sole discretion.
3. Use of Artificial Intelligence
Alma Art House LLC openly uses artificial intelligence (AI) tools in the creation and operation of our business. This includes AI-assisted website design, copywriting, marketing content, educational materials, business planning, and document drafting. This Website was built with AI assistance.
AI-generated content published on this Website and in our programs has been reviewed and approved by a human before publication. We take full responsibility for all content published under the Alma Art House LLC brand regardless of the tools used to create it.
By using this Website and engaging with our content, you acknowledge and consent to our use of AI tools in our business operations. We do not use AI to make automated decisions about you that have legal or significant personal effects without human review.
4. Website Forms and Lead Magnet Consent
By submitting any form on this Website, including contact forms, inquiry forms, application forms, free resource opt-ins, and booking request forms, you affirmatively consent to:

5. Booking and Client Relationships
A. No Relationship Until Confirmed
Visiting this Website, submitting an inquiry, or downloading a free resource does not create a client, student, or professional relationship. A confirmed relationship is established only upon mutual written agreement, completion of required intake and consent documents, and receipt of payment or deposit.
B. Paramedical and Tattoo Services
- All appointments require a deposit or payment in full at time of booking
- All deposits and payments are strictly non-refundable (see Section 8)
- Clients must complete all required intake and consent forms prior to their session
- We reserve the right to decline service if a health or skin condition makes a procedure inadvisable in our professional judgment — without refund of any amounts paid
- Results of paramedical tattooing vary based on individual skin type, scarring, healing response, and other factors outside our control. No specific outcome, color retention, or healing timeline is guaranteed
- Touch-up policies, if applicable, will be communicated at time of booking and are subject to our sole discretion
C. Appointment Cancellation and Rescheduling
- Cancellations fewer than 14 days before a scheduled appointment forfeit all deposits and payments — no exceptions, meaning deposits will not be applied to final session of services.
- Cancellations 14 or more days in advance may be eligible for a one-time rescheduling within 6 months; deposits are not refunded but may be applied to a rescheduled session at our discretion
- No-shows forfeit all deposits and payments with no opportunity to reschedule
- We reserve the right to cancel or reschedule appointments due to illness, emergency, or circumstances beyond our control; in such cases we will make reasonable efforts to reschedule
6. Fine Art Purchases
A. Ownership and Copyright
All fine art paintings are original works created by Justine Almaraz. Upon full payment, the buyer receives physical ownership of the artwork only. All intellectual property rights — including copyright, reproduction rights, licensing rights, and commercial use rights — remain exclusively with the artist unless a separate written licensing agreement is executed and signed by both parties.
You may not reproduce, print, digitize, distribute, display commercially, or create derivative works from any purchased artwork without prior written licensing consent from Alma Art House LLC.
B. Pricing and Payment
All prices are in USD. We accept payment via Square, Stripe, Kajabi checkout, HoneyBook, Venmo, Zelle, and cash. Prices are subject to change without notice, but confirmed orders will be honored at the price paid at time of transaction.
C. Shipping
- All shipping costs are the sole responsibility of the buyer and will be calculated at checkout or invoiced prior to shipment
- Risk of loss and title pass to the buyer upon handoff to the shipping carrier
- We are not liable for carrier delays, losses, or damages; we will assist with carrier claims but cannot guarantee outcomes
- If artwork arrives damaged, buyer must photograph damage and notify us within 48 hours of delivery to initiate a carrier claim
- We ship domestically and internationally; timelines will be communicated at time of purchase
D. Pickup and Delivery
- Local pickup is available by appointment at our Orange, CA studio
- Local delivery may be available at our discretion; all delivery fees are the buyer's sole responsibility and will be communicated in advance
E. All Sales Final
All fine art sales are final. We do not accept returns, exchanges, or issue refunds on any educational programs, memberships, services, deposits, artwork or any other purchase for any reason. We encourage you to review all photographs, dimensions, and descriptions thoroughly and contact us with questions before purchasing.
7. Education Programs — Alma Fine Art Tattoo Edu
A. Enrollment and Access
Enrollment is confirmed upon receipt of payment in full or execution of a signed payment plan agreement. Digital course access is granted upon enrollment confirmation for the duration specified at time of purchase. Access may not be transferred, shared, or gifted.
B. In-Person Intensives and Apprenticeship
- Schedules and locations provided at enrollment; subject to reasonable modification with notice
- One (1) reschedule permitted with at least 14 days' written notice; additional reschedules incur a $250 fee
- Participants must comply with all studio health, safety, hygiene, and professional conduct standards
- Dismissal for cause (disruptive behavior, non-compliance, harassment) results in forfeiture of all fees without refund
C. Independent Contractor Status
Enrollment does not create an employment, partnership, joint venture, or agency relationship. Students are independent individuals solely responsible for their own tattooing licenses, professional liability insurance, compliance with local regulations, business decisions, and tax obligations.
D. Our Growth Commitment
If you complete all assigned work, attend all required sessions, and fully apply the methods taught — and genuinely do not feel you have grown — we will personally work with you to provide additional support. This commitment does not constitute a guarantee of specific income, client volume, bookings, or business outcomes, which depend entirely on your individual effort, market, and personal circumstances. No specific earnings claim is made or implied.
8. Universal No-Refund Policy
ALL payments, deposits, membership fees, course tuitions, program fees, and purchases made to Alma Art House LLC — for any service, product, or program — are strictly non-refundable, non-transferable, and non-exchangeable for any reason.
This includes but is not limited to:
- Change of mind or personal circumstances
- Scheduling conflicts or inability to attend
- Dissatisfaction with creative results, artistic style, or outcome
- Medical or health conditions arising after booking or purchase
- Technical difficulties accessing digital content
- Relationship changes or business closure on the student's end
- Any reason not caused solely by gross negligence or willful misconduct on our part
By completing any payment, you confirm you have read this policy, understand it fully, and agree to it without exception or reservation.
9. Memberships
- All membership fees are non-refundable
- You may cancel at any time; upon cancellation, all access to content, community, resources, and benefits is immediately and permanently revoked
- Memberships are non-transferable and non-extendable unless otherwise stated in writing
- We reserve the right to modify, pause, or discontinue membership benefits with reasonable advance notice to active members
- Violation of community standards or these Terms may result in immediate termination without refund
10. STUDENT MEDIA, LIKENESS & CONTENT CONSENT
READ CAREFULLY — THIS IS A BINDING CONSENT
By enrolling in any Alma Fine Art Tattoo Edu program, course, workshop, intensive, or apprenticeship and as a condition of enrollment you provide your full, informed, irrevocable, and affirmative consent to the following:
What You Consent To:
- Being photographed, recorded, filmed, or otherwise captured on audio or video during any in-person session, online live session, community call, workshop, intensive, or apprenticeship interaction
- Your voice, name, image, likeness, work samples, and written submissions being used by Alma Art House LLC for any lawful purpose
- Content captured of you or submitted by you being used in marketing materials, social media (Instagram, YouTube, TikTok, Pinterest, and all other platforms), website content, paid advertising, course promotional materials, student success spotlights, testimonials, email campaigns, and educational program demonstrations
- Content being edited, cropped, combined with other content, captioned, or otherwise modified for these purposes
- Content being used in perpetuity — meaning indefinitely, without expiration — and worldwide
- Content being used without additional notice to you or additional compensation beyond your program enrollment
Kajabi Community and Digital Submissions:
- Any content you post in Kajabi community portals, program forums, group chats, or direct messages to the Company may be used for educational and marketing purposes
- Testimonials, progress photos, written feedback, and transformation stories you share within any program community or directly with us may be shared publicly
No Compensation:
This consent does not entitle you to any compensation, royalty, credit, or payment beyond what is included in your enrolled program. You waive any right to inspect or approve the final use of content featuring your likeness or submissions.
Opt-Out Process:
If you do not consent to this media release, you must submit a written opt-out request to [email protected] before your first session or enrollment confirmation, whichever comes first. Opt-outs are honored prospectively only. Content already captured or published prior to a valid opt-out request is not subject to removal. Note that opting out does not affect your enrollment or access to program content.
By completing enrollment and payment, you confirm you have read this entire consent section, understand it, and agree to it voluntarily and without duress. This consent survives program completion, withdrawal, or cancellation.
11. Intellectual Property
All content on this Website: including text, images, artwork, photography, videos, logos, course materials, business frameworks, training methods, and design is the intellectual property of Alma Art House LLC or its licensed contributors and is protected by United States copyright, trademark, and applicable law.
You may not copy, reproduce, modify, distribute, publicly display, sell, or create derivative works from any Website or program content without our prior written permission. Unauthorized use may result in legal action and claims for damages.
Student and program participants may not use course content, methodologies, frameworks, or proprietary materials to build competing educational products, courses, or programs. This restriction applies during and indefinitely after program participation.
12. Confidentiality
All proprietary information shared through our programs — including training materials, course content, business frameworks, teaching methods, community discussions, client case studies, workshop recordings, and any materials marked confidential — must be kept strictly confidential by participants.
You agree not to disclose, share, reproduce, distribute, post online, or transmit any such proprietary information to any third party without our prior written consent. This confidentiality obligation survives program completion, cancellation, or withdrawal indefinitely.
13. Educational Disclaimer
All educational content, business guidance, industry information, and creative instruction provided through our programs, Website, and communications is for educational and informational purposes only. Nothing in our programs, Website, or communications constitutes legal, financial, medical, regulatory, or professional advice/licensing advice.
Always consult licensed professionals — attorneys, accountants, healthcare providers, and regulatory authorities in your jurisdiction — before making legal, financial, health, or compliance decisions. Past student results described in testimonials or case studies are individual experiences and are not guarantees of your outcomes.
14. Media Release — All Clients and Website Users
By booking any service, attending any in-person session, or submitting photographs or content to us through any channel, you grant Alma Art House LLC the non-exclusive, royalty-free, perpetual right to use photographs, videos, or descriptions of your service results (with identifying information removed where appropriate for paramedical clients) for marketing, educational, and promotional purposes.
You may opt out of this release for service clients (non-education) by submitting a written request to [email protected] prior to your appointment. Opt-outs are honored prospectively.
15. Limitation of Liability
To the maximum extent permitted by California law, Alma Art House LLC, its owner, employees, contractors, collaborators, and affiliates shall not be liable for:
- Indirect, incidental, consequential, special, or punitive damages of any kind
- Lost profits, revenue, data, clients, goodwill, or business opportunities
- Physical results, healing outcomes, or allergic reactions from tattoo services where standard professional care and screening were performed
- Shipping carrier loss, damage, or delay
- Technical failures, platform outages, or unauthorized access to your account or data
- Any outcome resulting from your reliance on educational content, business guidance, or program materials
- Actions or omissions of third-party platforms (Kajabi, Square, Stripe, HoneyBook, COHART, Meta, Google, etc.)
Our total aggregate liability to you for any claim arising from use of our Website, services, or programs shall not exceed the total amount you paid us in the ninety (90) days immediately preceding the claim.
16. Indemnification
You agree to indemnify, defend, and hold harmless Alma Art House LLC and its owner, representatives, contractors, and affiliates from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of this Website or our services; (b) your violation of these Terms; (c) your violation of any applicable law or third-party rights; (d) content you submit to us; or (e) your tattooing practice, business operations, or application of skills learned through our programs.
17. Dispute Resolution and Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY — IT WAIVES YOUR RIGHT TO A JURY TRIAL AND CLASS ACTION.
Any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, our services, products, or programs — including questions of arbitrability — shall be resolved exclusively through final and binding individual arbitration, not in court, except as noted below.
Arbitration Terms:
- Arbitration shall be administered by JAMS under its Streamlined Arbitration Rules, or by a mutually agreed upon arbitrator if JAMS is unavailable
- Arbitration shall take place in Orange County, California, or via video conference at the arbitrator's discretion
- The arbitrator shall apply California substantive law
- Each party bears its own attorneys' fees unless the arbitrator finds a claim frivolous
- The arbitrator's decision is final and binding and may be confirmed as a judgment in any competent court
Class Action Waiver:
YOU AND ALMA ART HOUSE LLC EACH WAIVE THE RIGHT TO BRING OR PARTICIPATE IN ANY CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. ALL DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS ONLY.
Exceptions to Arbitration:
Either party may seek emergency injunctive or equitable relief from a court to prevent irreparable harm pending arbitration. Claims within the jurisdictional limit of small claims court are also excluded.
Opt-Out:
You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of first using our services. Opting out does not affect any other provision of these Terms.
18. Governing Law
These Terms are governed by the laws of the State of California without regard to its conflict of law principles. To the extent any matter falls outside arbitration under Section 17, the parties consent to exclusive jurisdiction and venue in the state or federal courts of Orange County, California.
19. Modifications
We reserve the right to modify these Terms at any time. Changes take effect upon posting to the Website with an updated Last Updated date. Your continued use of the Website or services after changes are posted constitutes acceptance. For material changes affecting active program enrollments, we will provide email notice.
20. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and all remaining provisions remain in full effect. These Terms, together with our Privacy Policy and any signed service or enrollment agreements, constitute the entire agreement between you and Alma Art House LLC and supersede all prior agreements.

You represent that you have all necessary rights to any content you submit, and that its use by us does not infringe any third-party rights. We will not use submitted content in a way that is defamatory, deceptive, or violates your reasonable privacy expectations.
9. Data Retention
We retain personal data only as long as necessary for the purposes described in this Policy:
- Client intake and paramedical service records: up to 7 years per California business record requirements
